Personal data – all information relating to an identified natural person or natural person identifiable by reference to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person, including the IP of the device, location data, internet identifier, and information collected through cookies or other similar technologies.

Policy – this Privacy Policy.

GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.

Law - the law of 10 May 2018 on personal data protection.

Online Store the HID-RATION online store operated by the Controller at the address www.hid-ration.com .

User – any natural person visiting the Online Store and using one or multiple services or functions as established in the Terms and Conditions.

Personal data processing objectives and grounds

In accordance with the scope of the operated business, the Controller shall process your personal data for various purposes, but always in a legal capacity. Your data is processed in scope of the following categories of activity:

  1. Browsing the Online Store

The data of all entities using the interactive internet platform (including the IP address or other identifiers and information gathered through cookies or other similar technologies) is processed by the Controller for one or more of the following purposes:

– handling purchases made without registration at www.hid-ration.comto Users, provision of contact forms – legal grounds of processing: requirement for purposes of the agreement (art. 6 section 1 point b of GDPR);

– handling purchases made without registration at www.hid-ration.com – legal grounds of processing: requirement for purposes of the agreement (art. 6 section 1 point b of GDPR);

– handling complaints – legal grounds of processing: requirement for purposes of the agreement (art. 6 section 1 point b of GDPR);

– analyses and statistics – legal grounds of processing: legitimate interest of the Controller (art. 6 section 1 lit f of GDPR) – based on analysing User behaviours, activity, and preferences in order to improve the quality and adequacy of the applied functions and provided services;

– potential establishment and pursuance of claims or defence against claims – legal grounds of processing: legitimate interest of the Controller (art. 6 section 1 lit f of GDPR) – based on protection of the Controller’s rights;

– marketing of the Controller and other entities, specifically in scope of presentation of behavioural advertisements – legal grounds of processing: legitimate interest of the Controller (art. 6 section 1 lit f of GDPR) – based on adaptation of the displayed advertising content; the standards of personal data processing for marketing purposes are covered in the section entitled “MARKETING”.

  1. Placing an order
  2. a) When a User places an order from hid-ration.com , the User’s personal data will be processed. Provision of data marked as required is voluntary, but required in order to process and deliver the ordered goods. If said data is not provided, the order cannot be placed. Provision of other data is optional and has no effect on fulfilment of the order.
  3. 4. b) The personal data provided in scope of placement of an order from hid-ration.com is processed for one or more of the following purposes:

– fulfilment of the placed order – legal grounds of processing:

– for required data – requirement for purposes of the agreement (art. 6 section 1 point b of GDPR), 

– for optional data – consent (art. 6 section 1 lit a of GDPR);

– fulfilment of the statutory obligations imposed upon the Controller, dictated specifically by fiscal and accountancy provisions – legal grounds of processing: legal obligation (art. 6 section 1 point c of GDPR);

– analyses and statistics – legal grounds of processing: legitimate interest of the Controller (art. 6 section 1 lit f of GDPR) – based on analysing User behaviours, activity, and preferences in order to improve the quality and adequacy of the applied functions and provided services;

– potential establishment and pursuance of claims or defence against claims – legal grounds of processing: legitimate interest of the Controller (art. 6 section 1 lit f of GDPR) – based on protection of the Controller’s rights;

  1. Marketing

The Controller processes the personal data of Users for purposes of marketing activity on the legal grounds of the Controller’s legitimate interest (art. 6 section 1 point f of GDPR). Said actions may include specifically the following:

– displaying marketing content to the User not customised to the User’s preferences (contextual advertising);

– displaying marketing content to the User customised to the User’s interests (behavioural advertising);

– sending e-mail notifications about interesting offers or content, which may contain commercial information;

– operating other activity in scope of direct marketing of goods and services (electronic distribution of commercial information and telemarketing activity).

If the User should agree to receive marketing information by e-mail, SMS, and other means of electronic communication, the User’s personal data shall be processed for the aforementioned purposes. In this instance, the grounds for data processing are the Controller’s legitimate interests, which are based on distribution of marketing information within the limits established by the consent granted by the user (direct marketing). The User has the right to object towards processing of the User’s personal data for purposes of direct marketing, including for the purposes of profiling. The data shall be stored for this purpose throughout the duration of the Controller’s legitimate interests unless the User should object to receiving marketing information.

  1. Cookies

The Controller uses so-called cookies primarily in order to provide the electronic services to the User and to improve the quality of said services. In light of this, the Controller and other entities providing analytical and statistical services to the Controller use cookies to store data or access data already stored in the User’s terminal telecommunications device (computer, telephone, tablet, etc.). The cookies used for this purpose include the following:

– cookies with data entered by the User (session identifier) for the duration of the session –authentication cookies used for purposes of services requiring authentication for the duration of the session;

– security cookies;

– session cookies of multimedia players;

– persistent cookies used to personalise the User’s interface for the duration of the session or for a somewhat longer time,

– cookies used to save the basket contents for the duration of the session,

– cookies used to monitor the website traffic, i.e. data analytics, including Google Analytics cookies.

Data storage

  1. In accordance with effective provisions of the law, we shall process your personal data for the time required to achieve the established objective. Following this time, your personal data will be irreversibly deleted or destroyed.
  2. 2. Your personal data will be processed by the Controller for the duration required to achieve the objectives discussed in section “Personal data processing objectives and grounds”, e.g. until discontinuation of your newsletter subscription, agreement for participation in our loyalty programme, or completion of a complaint procedure. Following this time, the data in question will be processed until expiration of potential claims or expiration of the responsibility to store data as dictated by provisions of the law.
  3. 3. Uses have the following rights in scope of their data:

Right to access information on personal data processing – when this right is exercised, the Controller discloses information on personal data processing to the data subject, primarily concerning the objectives and legal grounds of processing, the scope of held data, the entities having access to said data, and the planned time of deletion of said data;

Right to obtain a copy of the personal data – when this right is exercised, the Controller releases a copy of the processed data of the data subject;

Right to rectify the data – when this right is exercised, the Controller releases a copy of the processed data of the data subject;– when this right is exercised, the Controller removes any potential inconsistencies or errors in scope of personal data processing and completes or updates the data in question whenever it is incomplete or has been subject to change;

Right to delete the data – this right can be exercised to request deletion of data, which no longer needs to be processed for any of the purposes, for which it was gathered;

Right to restrict processing of the data – when this right is exercised, the Controller ceases processing on the personal data with exception of operations approved by the data subject and data storage in accordance with assumed retention standards or until discontinuation of the reasons of data processing restriction (e.g. when the supervisory authority releases a decision permitting further data processing);

Right to transfer data – when this right is exercised, the Controller releases the data provided by the data subject in a computer-readable format in scope of data processing in scope of a concluded agreement or granted consent. It is also possible to request transfer of said data to a different entity as long as both the Controller and said different entity hold technological capacity to do so;

Right to object towards processing of data for marketing purposes – the data subject may object to processing of personal data for marketing purposes at any time without the need to clarify said objection;

Right to object towards other data processing purposes – the data subject may object to processing of personal data based on the legitimate interest of the Controller (e.g. for analytical or statistical purposes of for reasons of property protection) at any time. This objection should be clarified and is subject to evaluation of the Controller;

If the Controller processes your personal data based on your consent, you can revoke said consent at any time at your discretion.

If your personal data is processed in violation of effective law, you can file a complaint to the President of the Personal Data Protection Office.

Your personal data shall not be released to third countries, i.e. outside of the European Economic Area (EEA) or outside of international organisations.
